No grounds to remove EC Chair, Deputies — Chief Justice tells John Dramani Mahama
The Chief Justice, Paul Baffoe-Bonnie, has ruled that no prima facie case has been established in the petitions seeking the removal of the Electoral Commission Chairperson, her deputies and the Special Prosecutor.
A statement issued by the Presidency on Wednesday, February 18, 2026, said John Dramani Mahama had referred seven petitions calling for the removal of the Electoral Commission Chairperson, Jean Mensa, and her deputies, together with three separate petitions against the Special Prosecutor, Kissi Agyebeng, to the Chief Justice for advice.
The referral, made on November 25, 2025, was in line with Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959), to determine whether the petitions disclosed a prima facie case to warrant further action.
In a letter dated January 26, 2026, the Chief Justice informed the President that the petitions did not establish sufficient grounds to justify investigations or removal proceedings against the affected office holders.
The statement, signed by the Minister for Government Communications and Presidential Spokesperson, Felix Kwakye Ofosu, said the decision effectively brings the matter to a close at this stage.
